Hiring Your First Employee in Kuwait: PAM File, Visa Quotas & Payroll (2026 SME Guide)

In Kuwait the answer is longer than you'd expect — because hiring is not one process, it's four government files (PAM, visa, PIFSS, WPS payroll) stacked on top of a compliant employment contract. Miss any one of them and the next audit costs you KD 1,000+ per employee. Here's the sequence that actually works.
Step 1 — Open your PAM (Manpower) file
Before you can hire anyone, your company needs an employer file at the Public Authority of Manpower (PAM). Requirements:
- Current commercial license and CR
- Authorised signatory Civil ID
- Company address proof (tenancy contract)
- Municipality license for the premises where staff will work
- Corporate bank account (for WPS enrolment)
File opening takes 3–7 business days. Fee: KD 5. Once open, you can request your first work-permit quota — the number of expat employees your company is allowed to sponsor, calculated on business type, capital and office size.
Step 2 — Understand the visa options
Article 18 — private-sector work visa (expats)
The default visa for a company hire. Tied to your PAM file and revocable if the employee leaves. Fees: KD 10 (application) + KD 2/month permit + KD 50 residency stamp. Timeline 3–6 weeks including medical (خضوع طبي) and security clearance.
Article 20 — domestic worker
For household staff, not for company employees. Do not use it to hire drivers or office staff — it's a common founder mistake that voids the contract.
Kuwaitis and GCC citizens
No visa required. Registered at PAM as a direct hire in 1–3 days. Kuwaiti hires also unlock partial Manpower Support Program subsidies (up to KD 500/month) if your business qualifies.
Step 3 — Draft a Kuwait-compliant employment contract
Kuwait's Private Sector Labor Law (Law No. 6/2010) mandates a written contract in Arabic. Key clauses to get right:
- Fixed vs indefinite term. Indefinite contracts default to Kuwait law; fixed-term contracts cannot exceed 5 years.
- Probation. Max 100 working days. During probation either party can terminate with no indemnity.
- Working hours. 48 hours/week (8/day, 6 days) or 45 hours in Ramadan. Overtime = 1.25× normal rate.
- Annual leave. 30 days after 9 months of service. Cannot be waived, only rolled over up to 2 years.

The contract must be filed with PAM within 30 days of the employee starting. Filing an English-only contract with no Arabic version is unenforceable in Kuwait courts.

Step 4 — Enrol in PIFSS (Kuwaitis only) and set up WPS payroll
PIFSS (social insurance)
The Public Institution for Social Security covers Kuwaiti and GCC nationals only. Employer contribution: 11.5% of salary. Employee contribution: 8%. Registration is mandatory and must be filed within 30 days of the hire. Expats are not enrolled in PIFSS — their end-of-service gratuity is the equivalent.
WPS — Wage Protection System

The five traps first-time employers walk into
- Hiring on a family/visit visa. Illegal, KD 2,000 fine per case.
- Verbal contracts. Unenforceable in Kuwait courts — the employee's version wins.
- Paying salary in cash. Breaks WPS compliance and voids many insurance claims.

PAM (the Public Authority of Manpower — الهيئة العامة للقوى العاملة) is Kuwait's labour ministry.
