Work Permit and Visa Transfer Steps for a Kuwait SME

Hiring in Kuwait is rarely about the interview. It is about whether your company file can legally carry the person you want to employ, and whether the paperwork moves through the ministries in the right order. Most SME delays we see are not refusals — they are avoidable sequencing errors. 1. Start with your company file, not the candidate

Before you promise anyone a job, confirm three things: your commercial licence is active and not close to expiry, your government dues are clear, and your manpower file has an available approved position that matches the role you are hiring for.

2. Check the activity code against the job title

Work permits are approved against the activities registered on your licence. A job title that has no plausible link to your registered activity is one of the quieter reasons files get returned.

3. Quota approval

Your file carries a limited number of approved positions, and the mix is influenced by your activity, premises and existing headcount. If the quota is exhausted, you apply to increase it before anything else happens.

Plan for this. Quota requests are reviewed, not rubber-stamped, and a rejected request often means adjusting the role, the premises or the timing rather than reapplying with the same file.

4. New hire from abroad vs transfer from inside Kuwait

From abroad: work permit issued under your file, visa sent to the employee, entry, medical examination, biometrics, then residence stamping.

Transfer inside Kuwait: the employee's relationship with the current employer must be properly closed or released, the new permit is issued under your file, and the residence is amended. The employee's current status — including how long they have been with their present employer and whether their residence is valid — determines what is possible.

Transfers look faster on paper and are often slower in practice, because they depend on a third party you do not control: the current employer.

5. The document pack

Prepare these before you submit anything:

  • Valid commercial licence and company authorised-signatory documents
  • Passport copy with sufficient validity
  • Attested academic certificates where the role requires them
  • Employment contract in the required format
  • Photographs and civil ID details to the current specification
  • Release or contract-end documentation for a transfer

Attestation is the single most common bottleneck for degree-based roles, and it is done in the home country. Start it early — it is the one stage no PRO can accelerate from inside Kuwait.

6. Medical, biometrics and residence stamping

The employee attends the medical examination and fingerprinting in person. Once results clear, the residence is stamped and the civil ID is issued. Only at this point is the person legally working for you.

7. After the transfer: the calendar you now own

Residences expire, contracts renew, and work permits must be kept aligned with your licence status. Late renewal of a residence carries daily penalties, and an expired employee residence can complicate your whole file.
